About Katherine

Katherine Guilfoyle has been assisting clients with her solution focused approach to the law as a solicitor, for to close to a decade. 

Katherine understands first hand how expensive, stressful and time consuming Court litigation is, and that's why she is so passionate about alternative dispute resolution. There are significant benefits to resolving your matter at mediation, such as:

 

  •  Mediation allows you to decide the outcome (rather than a third party like a judge). This means you may avoid the uncertainty of Court proceedings and obtaining an outcome that is unexpected or not desired. It can be difficult to predict how the evidence may fall following cross examination, it can be difficult to predict the content of expert reports (eg valuations, family reports);

  • Mediation can cost a fraction of the cost of proceeding to Court and reaching a final hearing;

  • Depending on party availability, mediation can be organised and completed within 2-4 weeks. It can take years to reach a final hearing in Court. Court proceedings usually involve many Court appearances, letters, emails and can include valuations which can increase stress for a lengthy period of time. Mediation occurs over one, sometimes two days.

As Your Mediator

As your Mediator I can:​

  • Assist you to discuss, explore and negotiate the issues relating to your matter;

  • Reality test proposals in relation to short term and long term sustainability;

  • Document points of agreement;

  • Provide legal information (not legal advice);

  • If both parties are legally represented and consent, I can provide evaluative mediation services where I offer my opinion in relation to issues in dispute;

  • For un-represented parties I offer facilitative mediation services during which I remain impartial and unbiased;

  • Prepare a Parenting Plan (for family law parenting matters);

  • Prepare a Heads of Agreement setting out your financial or other arrangements;

  • For family law parenting matters we can issue a section 60I certificate; and

  • Complete a risk assessment, explain the different types of mediation processes and assist you to elect the right process for your situation.
